DAMAGES AND REPAIRS
By signing below, you (“Guest”) agree to the following terms and conditions regarding your stay at Petit Soleil (“Hotel”).

Inspection: Guest agrees that the condition of the room will be inspected before check-in and after check-out. Any damage noted upon check-out that was not present at check-in, and is not the result of normal wear and tear, (collectively, the “Damage”) will be the responsibility of the Guest.

Liability for Damage: Guest acknowledges, understands, and agrees that Guest is solely responsible for any and all Damage caused to the room, furnishings, fixtures, and other property of the Hotel due to any acts or omissions of Guest, or any visitors of Guest, during Guest’s stay. Guest hereby agrees to indemnify, defend, and hold harmless the Hotel and its owners, agents, employees, and contractors, from any and all costs, liabilities, and damages incurred by the Hotel due to any acts or omissions of Guest, or any visitors of Guest, during Guest’s stay.

Repair and Replacement Costs: The Hotel will notify the Guest in writing of any Damage found, along with an itemized list of repair or replacement costs. The Guest will have five (5) days to contest these charges in writing. The Guest will be billed for the cost of repairing or replacing the damaged item(s), as determined by the Hotel. Guest hereby authorizes the Hotel to charge Guest’s credit card on file for any costs to repair or replace damaged item(s) that does not exceed $750.00.

Legal Action: Failure to pay for the cost to repair or remediate the Damage may result in legal action against the Guest.

Force Majeure: Guest will not be held responsible for Damage caused by acts of God, natural disasters, or other unforeseen circumstances beyond the control of either party.

NOTICE: Petit Soleil (the "Hotel") is committed to the prevention of underage drinking. Your room key includes access to an in-room controlled access liquor cabinet. Pursuant to Business and Professions Code Section 25658, every person who sells, furnishes, gives, or causes to be sold, furnished, or given away, any alcoholic beverage to any person under the age of 21 years is guilty of a misdemeanor. By signing below, you acknowledge and agree that: (i) you are at least 21 years of age; (ii) you will not provide your room key to any person under the age of 21; (iii) you are the sole party responsible for supervising any person under the age of 21 with access to your Hotel room; and (iv) you will not sell, furnish, give, or cause to be sold, furnished or given away, whether by act, omission, or otherwise, any alcoholic beverage to any person under the age of 21 years. Furthermore, you agree to indemnify, defend, and hold harmless the Hotel and California Alcoholic Beverage Control licensee 1473 Monterey Street, LLC, a California limited liability company, from and against any and all claims, liens, penalties, demands, losses, taxes, costs, expenses, litigation, liabilities, damages, recoveries and deficiencies, including interest, penalties and attorney’s fees, incurred by or derived from a violation of this section.
